Legal terms and conditions for using DATIP.AI services

These Terms of Service ("Terms") govern your use of the DATIP.AI website, Private AI Platform, and services provided by DATIP B.V. By accessing or using our services, you agree to these Terms.

1. Services Provided

DATIP provides AI consultancy, automation, software engineering, the Private AI Platform, and related infrastructure services. The platform may be self-hosted, DATIP-hosted, or on-premises.

2. Account Responsibilities

You are responsible for maintaining account security and ensuring that all users comply with these Terms.

3. Customer Data & AI Inputs

You retain full ownership of the content, documents, data, and prompts processed in your AI environment. DATIP acts as a Data Processor for such data and does not use it to train public AI models.

4. Acceptable Use

You may not use our services to:

  • violate laws or regulations
  • distribute harmful or illegal content
  • compromise systems or networks
  • infringe intellectual property rights

5. Intellectual Property

DATIP retains all rights to its software, AI Platform, and documentation. Custom-built components follow licensing defined in project agreements.

6. Service Availability

While we strive for high availability, uptime is not guaranteed unless specified in a Service Level Agreement (SLA).

7. Payments and Billing

Fees, payment terms, and billing cycles are outlined in your proposal or contract. Failure to pay may result in suspension of services.

8. Termination

Either party may terminate the agreement according to contract terms. Upon termination, access to the platform ends and data will be returned or deleted according to the DPA.

9. Limitation of Liability

DATIP is not liable for indirect or consequential damages. Total liability is limited to the amount paid in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by Dutch law. Disputes will be handled by the competent court of the Netherlands.

11. Changes to These Terms

We may update these Terms when necessary. Significant changes will be communicated.
